Terms of Use

Welcome. These Terms of Use (“Terms”) govern your use of sdjewishbusiness.com and any of its subdomains (the “Site”), operated by San Diego Jewish Business Networking (“we,” “us,” or “the Group”), an informal networking group organized by David Lizerbram and Daniel Diamond. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What this Site is

The Site exists to post information about the Group’s gatherings and to let people reach an organizer. The Group is an informal gathering. It is not a corporation, partnership, association, or membership organization, and attending an event does not make you a member of anything or give you any ownership or voting rights.

2. Events

Event dates, times, and locations posted on this Site may change or be cancelled without notice. We do not guarantee that any event will take place, that any particular person will attend, or that you will make any business connection by attending. Venues are third parties, and you are responsible for anything you order or agree to at a venue. You attend at your own risk and are responsible for your own conduct.

We may decline to respond to any submission, remove anyone from our email list, and ask anyone not to attend an event, at our sole discretion and for any reason.

4. What you send us

You are responsible for anything you send us through the Site. Do not send anything you do not have the right to send. If you send us a suggestion or idea about the Group, we may use it without any obligation to you. How we handle information you send us is described in our Privacy Policy.

5. Intellectual property

The text, design, layout, and other content of this Site belong to us or our licensors, and are protected by copyright and other laws. You may view and print pages for your own personal or internal business use. You may not copy, republish, or redistribute the Site or its content for commercial purposes without our written permission. Any third-party names, logos, or trademarks that appear on this Site belong to their respective owners.

6. Links to other sites

This Site may link to websites we do not control, including venues, maps, and organizers’ businesses. We provide those links for convenience only. We do not endorse those sites and are not responsible for their content, their accuracy, or anything you do on them.

7. Disclaimer

The Site is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Site will be uninterrupted, error free, or secure, or that the information on it is accurate, complete, or current.

8. Limitation of liability

To the fullest extent permitted by law, neither the Group nor its organizers, nor their respective firms, employees, or agents, will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost business, or lost data, arising out of or relating to the Site or any event, whether based in contract, tort, or any other theory, even if we have been advised of the possibility of such damages. Our total liability for all claims relating to the Site or any event will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Group and its organizers from any claim, loss, or expense, including reasonable attorneys’ fees, arising out of your use of the Site, your conduct at an event, or your violation of these Terms.

10. Changes

We may change these Terms at any time by posting a revised version on this page. The date at the top shows when they last changed. If you keep using the Site after a change, you accept the revised Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of those courts.

12. General

If any part of these Terms is held unenforceable, that part will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. Section headings are for convenience only.
